Welcome to MAKAN360 . These Terms and Conditions (“Terms”) govern your access to and use of our property marketplace website and mobile application (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

1.1. Agreement: You must be at least 18 years old and legally competent to enter into this agreement. By using the Service, you confirm that you meet these requirements and agree to these Terms and our Privacy Policy. 1.2. Changes: We reserve the right to modify these Terms at any time. We will notify you of material changes. Continued use of the Service after changes constitutes acceptance of the new Terms.

2. User Registration and Accounts

2.1. Account Creation: To access certain features, you must register and create an account using your full name, email, and phone number. 2.2. Account Responsibility: You are solely responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. 2.3. Verification: You agree to provide accurate, complete, and current information. We reserve the right to request verification documents (such as CNIC/Passport) to ensure the integrity and trust of the platform.

3. Use of the Service and Prohibited Activities

3.1. License: We grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal and commercial real estate purposes in Pakistan. 3.2. Direct Transactions: Our Service is designed to facilitate direct communication between buyers, sellers, and renters, eliminating the need for traditional commission agents. 3.3. Prohibited Conduct: You agree not to: * Post false, misleading, or fraudulent property listings or information. * Use the Service for any unlawful purpose or to promote illegal activities. * Impersonate any person or entity. * Transmit any viruses, worms, or malicious code. * Collect or harvest personal data from other users without their consent.

4. Listings, Content, and Transactions

4.1. User Content: You are solely responsible for the property listings, photos, descriptions, and other content you upload (“User Content”). You warrant that you own or have the necessary licenses to all User Content. 4.2. Accuracy: You acknowledge that MAKAN360 does not inspect, verify, or guarantee the accuracy, legality, or condition of any listed property. Users must conduct their own due diligence, including property inspection, title verification, and legal checks. 4.3. Transaction Risk: All transactions (buying, selling, renting) are conducted directly between the users. MAKAN360 is not a party to the transaction and assumes no liability for the outcome, disputes, or losses arising from such transactions. 4.4. Property Documents: While we do not require users to upload property documents, we advise buyers/renters to independently request and verify all necessary legal documentation (e.g., Fard, mutation papers) from the seller/landlord before finalizing a deal.

5. Fees and Payments (For Paid/Exclusive Listings)

5.1. Free vs. Paid: Our Service offers free standard listings and premium “Featured Exclusives” (Paid Listings) for enhanced visibility. 5.2. Payment: Fees for Paid Listings are specified on the pricing page. All payments are processed through secure third-party payment processors (e.g., banks, payment gateways). We do not store your bank or card details. 5.3. Refund Policy: All fees paid for premium listings are non-refundable, except where explicitly stated otherwise by MAKAN360.

6. Intellectual Property

6.1. Our IP: All content on the Service, excluding User Content (including text, graphics, logos, and software), is the property of MAKAN360 or its licensors and is protected by copyright and intellectual property laws. 6.2. License to Us: By submitting User Content, you grant us a worldwide, royalty-free, perpetual, and transferable right to use, reproduce, modify, adapt, publish, and display the content on the Service and in related marketing materials.

7. Disclaimers and Limitation of Liability

7.1. Disclaimer of Warranties: The Service is provided “as is” and “as available.” We expressly disclaim all warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. 7.2. Limitation of Liability: To the maximum extent permitted by law, MAKAN360 shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, resulting from: * Your access to or use of (or inability to access or use) the Service. * The conduct or content of any third party or other user on the Service. * Unauthorized access, use, or alteration of your transmissions or content.

8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Pakistan. You agree that any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Specify City/Province in Pakistan, e.g., Karachi, Lahore or Islamabad.

9. Termination

We reserve the right to suspend or terminate your account and access to the Service immediately, without prior notice or liability, if you breach these Terms or engage in any conduct that we deem harmful to the platform or other users.
